The Constitution of Governing bodies of maintained schools -DfE August 2015

Great Wakering Primary School Governing Body Stucture

Following publication of the DfE 'The School Governance Constitution Regulations 2012, we reconstituted the Governing Body of Great Wakering Primary School in order to carry out our Core Functions more effectively.

Our membership, as per The Instrument of Government 3rd December 2012, comprises:

  • 3 parent governors
  • 1 Local Authority governor
  • 2 staff governors (including the headteacher)
  • 6 co-opted governors, one of whom is co-opted as a staff governor
  • Currently (September 2016) we have 3 co-opted governor vacancies

Job Descriptionis for Key Roles within the Governing Body

During 2014/15 the Governing Board attempted to answer the question, 'What does a governor actually do?' This proved to be a challenging question because the role of governor is wide ranging and varied, but we considered it an important question to pursue and by the end of the year had completed the following document. We hope all governors, and particularly potential governors will find it useful. We recognise that our roles are constantly changing as new educational legislation comes into effect and we will therefore update this publication at regular intervals throughout the coming year.

Our job descriptions for Chair, Vice Chair, and Clerk first published in 2014, are regularly reviewed and amended.

The Governing Board at the Annual General Meeting held on 28th September 2015 adopted the following Standing Orders for the academic year 2015/16

Governors' Code of Conduct 2015-2016

As a member of the National Governors Association (NGA) we adopt many of their model documents. Governors are reminded that our Code of Conduct 15.16 based on the latest NGA model, should be read alongside Statutory Policy 26a - Code of Conduct, and special note should be taken of all reference to electronic communication and the use of Social Networking sites.

Terms of Reference for Committees and Panels 2015/16

Our Terms of Reference for Committees and Panels have been reviewed and updated in line with government and Local Authority guidelines.

Delegation Planner 2015/16

Although Governing Bodies are accountable in law for all major decisions about the school and its future, we are not required to carry out all the work ourselves. Our role is strategic and we therefore delegate many of the tasks to committees and individuals as recorded in the attached Delegation Planner that has been agreed for the academic year 2015/16.

The School Governance (Roles, Procedures and Allowances) Regulations

This advice from the Department for Education is non-statutory, and has been produced to help governors understand their duties in relation to the School Governance (Roles, Procedures and Allowances) (England) Regulations 2013. It covers:

  • Role of the governing body and headteacher
  • Delegation and committees
  • Role of the chair/vice-chair
  • Role of the clerk
  • Procedures
  • Allowances

The Role of Governors and Safeguarding

Safeguarding guidance was updated on 5th September 2016
The Governing Body has a duty to ensure that the school meets its statutory responsibilities and ensure that the children and young people attending the school are safe. This applies equally to all school settings, including maintained schools, academies and free schools. Section 175 of the
Education Act 2002, and regulations under section 157 relating to safeguarding pupils in Independent Schools (including academies), place a duty on the governing bodies of maintained schools, and academy trusts, to have arrangements in place to ensure that they:

  • carry out their functions with a view to safeguarding and promoting the welfare of children; and
  • have regard to the statutory guidance issued by the Secretary of State in considering what arrangements they need to make for the purpose of that section

Governing Body Year Planner

We have adopted the Governing Body Year Planner published by Essex. (See below) It is particularly useful in the way actions are listed under our three core functions. Committee Chairs use the planner as an aid to agenda setting for both full governing body and finance committee meetings.

Information Governing Bodies Must Ensure Schools Publish

One of our roles is to ensure that the school pubishes all information required by statute.

The school should also publish any other policies  that might be relevant to a potential parent considering expressing a preference for the school.

In addition the governing body should ensure that the school\;

  • keeps  pupils'  curricular and educational records and provides parents with access to them
  • reports at least annually to parents on their children's progress and educational achievements
  • provides a report to school leavers
  • makes sure that the pupils' educational records and common transfer files (CTF) are transferred securely to schools pupils move to.

A governing bodyshould also make availiable agendas, approved minutes and papers of its meetings and committees with delegated powers.

Electing a Chair and Vice-Chair (NGA Guidelines)

The NGA suggested procedure will apply any time there is a vacancy for chair or vice chair and at the first meeting of the academic year in which re-election is due. When the office of chair or vice chair becomes vacant, the governing body must elect a chair/vice chair at the next meeting.

The Governing Board September 2015-July 2016

In the interests of transparency, governing bodies are now required to publish up to date details of their governance arrangements on the school website. This requirement came into force on 1st September 2015 and was updated in September 2016.
